Description:
This is a stipulated motion for an extension to file a pleading with the court. This is usually used when one side wants more time to file an answer or a response to a motion to dismiss (or a motion for summary judgment). What stipulated means is that both sides agree to it. Usually these motions are only filed in federal court. Generally in state court, when both sides agree to an extension, they dont file a notice with the court. Both sides must sign the extension motion, AND the moving party must also submit an Order Granting the Motion for Extension (this order should also be archived on the Opticon). The judges will usually approve these no problem if both sides have agreed. It is in Word format and is two pages.
